I booked a flat 3 yrs ago, no approvals till date, we asked builder to return booking amount. After 3 months chasing we get a cheque which bounced. what action ?

Asked by mita mehra in Consumer Rights at   2:14 PM on September 08, 2008

Mukta Sharma's Answer

You can take two action one under Section 138 Negotiable Instruments Act for cheque bouncing. After receipt of the memo from bank intinating the cheque you have to give a notice asking the ssuer of the cheque to make payment within 15 days of the receipt of the notice. In case he fails to do so the offence under Secion 138 is committed. Then you have to file a complaint before the Magistrate having jurisdiction in the matter.
The second option is you can file a complaint before the consumer court and ask for damages from the builder for the losses you sustained.
Thanks.

Asked by Gauri in Law at   4:31 PM on September 08, 2008

Mukta Sharma's Answer

The divorce is not valid. The valid divorce is one which taken through Court of law. Your friend should file a petition for divorce by mutual consent with his wife and obtain a decree of divorce from court of law. If they will not obtain such divorce the second marriage is not valid and will be treated as bigamy.

Sud male doctors and male attendents allowed to operate female patient? It sud be taken in conserderation that she have to be completly naked there.

Asked by Manish in Consumer Rights at   2:55 AM on September 02, 2008

Mukta Sharma's Answer

Your question is not right. Doctor is a doctor the question of gender does not arise so far a relationship of doctor and patient is concerned. It is the experience and competence that matters and not the gender. If a male doctor is available and who has ample experience and highly skilled and competent then why he should not operate a female patient. Besides at the time of operation the doctor's concern is health of patient then anything else. So male doctors and attendents should be allowed to operate the female patient if the doctor and the entire team is well experienced and competent to tackle any emergency during operation.
