My friends paid Rs.5K for buy a loading rikshaw as a down payment but loan was not sanctioned and he asked money back but dealer don't given back .Can I file

If your friend has a receipt signed by the dealer, then he may file case on the basis of receipt given by the dealer. Without any proof, one cannot file any case. Even in that circumstances, your friend cannot ask for sanction of loan. Through Court, he may pray for recovery of the amount paid by him.

After fininshing LLB Course, one has to register himself in the Bar Council of his State and join as a junior to a senior advocate for knowing about the practical work in court. You should also become a member of Bar association of the City Court to which you are doing your practice. You may also directly practice in the Court without joining with any senior advocate. But, it is very difficult.

Once you get practical training for atleast 2 to 5 years, you are eligible to appear for judicial examination. Judicial examination at the entry level grade are conducted by State Public Service Commission with the consulation of High Court of that State. Whenever examinations are conducted, advertisment will be issued in leading daily newspapers in local, regional and also in English language. There is no specific website to see the information for all judiclal examination.

if the railways donot allot reservation to waiting list tickest holders then y do they charge a fee for cancellation of such tickets?

You have asked 4 questions continuously in this subject. Each one is inter-related between each other. I am furnishing below the answers for all these questions.

It is already stated by the railways that there is no seat guarantee for the persons who are in the waiting list. So, there is no fault at railways side.

If no amount is collected for cancellation of waiting list, then everybody will apply for waiting list tickets and cancel it routinely which would be a heavy work and expense for railways. To streamline this, the railways collect charges for cancellation of waiting list tickets.

Till a few days before the date of departure, railways allow to book tickets under waiting list. It may go upto 1000. If all the waiting list ticket holders can stand on reservation coach, then there will no place for the confirmed ticket holders to go here and there in that coach. Moreover, only RAC ticket holder shall be given preference in case of cancellation of tickets by confirmed ticket holder. So, waiting list ticket holders are not permitted to go in reserved coach.

I have lost my PAN card from where i would get new one and what is the process to get?

First, you have to give a complaint to police for the loss of your PAN card and get FIR copy from them. Thereafter, you may apply for PAN card through the same office from whom you had got it previously. In your application, you need to enclose a copy of FIR, and also proof for your photo identity and residence proof.

I want to file case against SBI Credit Card people?

Please tell me the purpose for which you require to file a case against SBI credit card people. Before you signed the agreement for obtaining credit card, you ought to have read the terms and conditions for obtaining credit card. Most of the people are in the practice of signing the agreement without reading the statement in it.

I have gone through two or three in these type of cases. If you are not in a position to pay the debt due on the credit card, it is better to get loan from somebodyelse and pay the entire debt due in one installment by requesting them some deductions. You may tell them that you are innocent to know about the rules governing the credit card. They may allow you some deductions. Thereafter you may cancel your card.

Credit cards are danger for middle class people. If you do not pay the ENTIRE debt due within the stipulated date, it will start calculating the compound interest monthly at the rate of approximately 3% per month for the ENTIRE amount eventhough you had paid a certain percentage of debt. So, it is better for the middle class people to avoid credit cards.

It is not easy to file a case before court. You have to spend time and money. The quantum of such money and time may vary from case to case depending upon the circumstances of each case. It may sometimes go beyond the actual relief you are praying in that case. Please calculate all these before thinking of filing a case.

If their customer service are poor, you may complain it with their customer care centre. If you have paid last payment, you may inform it with the number, amount and date. It is better to go in person to their office and tell your facts. You may also send E-mail putforthing the details of your problems to them.

What is the best way to invest in mutual fund, SIP or investing a lump sump amount at a time?

Investing in SIP method is best for those who do not have sufficient money to meet their emergency, unexpected family expenses. Investing in lump sum is best for those who have sufficient money for running their family. i.e. they are not in such a position to sell the mutual fund within 3 years to meet their regular expenses.

However, in my opinion, at present the SENSEX has down from 21000 to 9000. There is much chance of still down the SENSEX. Many mutual funds units are selling less than half the rate that was sold 10 months back. If you have extra enough money for running the family, then you may invest in lump sum in mutual fund. If you do not have enough money to meet your emergency expenses and regular expenses, you may opt SIP.

Will I get a more than 20 % return if I invest in SBI Magnum Taxgain Scheme 1993 mutual fund in the month of December,2008 for a period of three years?

There may be chances for getting 20% return if you invest in SBI Magnum Tax Gain Scheme. However, there is no guarantee for such return in mutual funds. It depends upon the market condition of the shares which were bought by the AMC of that mutual fund. At present, the prices of stocks and units of mutual funds are in volatile. In my opinion, you may invest upto Rs.1,00,000/- in a nationalised bank fixed deposit scheme for 5 years to get definite interest and principal. Such investment of Rs.1,00,000/- (Rupees one lakh only) is eligible for tax deduction.

You did not mention anything about your case. Through this ibibo you can clarify your major doubts. For the purpose of filing a case, you can meet an advocate and putforth him all the facts. You have to explain in detail for all the questions to be asked by advocate. You should give all the documents to the advocate for his scrutiny. Once he has seen all the documents, he may be in a position to say whether your case is fit for filing before Court or not.

If you receive cash gift from your mother-in-law, it is not taxable. There is no limit of such cash gift.

However, in my opinion, it should be in writing. A Gift deed should be prepared which contains the name and address of the persons giving the gift, the name and address of the person accepting the gift, the amount, the RELATIONSHIP between them and also the witnesses. It must be registered so that you may prove that it the cash amount is gift.
