See dear the problem of J&K is the problem which was Imposed on the citizens of India by most powerful pseudo secularist political party i.e Congress .even the Congress leaders of that time were unable to define there stand on kashmir after Nehru death . some of the facts about the Kashmir are that when India got its independence in year 1947 the question of joining India or Pakistan of dominions of British India which were ruled by them indirectly through native prince were left to individual monarchs of provinces . Maharajah Hari Singh ruled on Jammu and Kashmir at that time and he decided not to join any dominions than there was rumor that Maharaja was going to decide for the union with India than The irregular Pakistani tribals aided from Pakistani regular army started making advance in Kashmir Maharaja Hari Singh of Kashmir asked the Government of India to intervene but government replied to hari singh that until Kashmir signs
the Instrument of Accession in favor of India cant give military aid to Kashmir and accordingly maharajah Instrument of Accession in favor of India .and our forces started advancing in Kashmir
not only that that recovered nearly two third of the land of Kashmir from illegal occupation of Pakistani army .our forces were at having upper hand in the battle at this juncture J.L Nehru decided to take issue to U.N council and a resolution was passed on April 21, 1948 imposing immediate cease fire and withdrawal of all Pakistan presence in the state and to hold impartial plebiscite conducted under the auspices of the United Nations .The cease fire took place December 31, 1948.now when it was decided to hold memorandum in Kashmir Indian Government assured Kashmiris to treat Kashmir as special case until plebiscite is conducted in the region so no non Kashmiri would be able to buy land in this region and can not have right to take part in plebiscite on property qualification and to have minimum interference in administration and to leave people of Kashmir to rule themselves according to there will until plebiscite is conducted but as the matter of fact Pakistan army never withdrawed its army from the region this plebiscite was never been held and this is the reason that they are having separate constitution and article 370. the major fault of our government at that time was that when our army were defeating the enemy forces than why our government approached to U.N this issued could have been solved at that time only militarily . than why it accepted to held plebiscite in the region having example of N.W.F.P and sindh where the referendum was one by Pakistan on religious grounds and table were changed fortnightly after the chief quasi issued fatwa for voting in favor of Pakistan and the referendum became fight between quran and gita .probably goverment of that time was not able to keep its stand in U.N .when police action was taken in case of Hyderabad why it was not taken in case of Kashmir .It is difficult to say that when parliament will abolish article 370 because if any government even tries to do say it can lead to have a major outcome muslims are in majority in Kashmir and it once again lead to fight between quran and gita .article 370 in Kashmir is like a grave danger for autonomy of India firstly it does not allow central government to take stern action in region secondarily as a citizen of India I regard J&K as integral part of India and it is might fundamental right to settle anywhere in my country and this article clearly violates my fundamental right.
