it depends on the situation. because sometimes the owner may in force the dog to bite someone else. so in this case the owner should be asked. if the person is beaten because of his carelessnesse the owner should not be asked.

as long as somebody fidels with the dog and the dog bite,its owner's fault....the solution is rather situational.
