Commercial Surrogacy is legal in India since 2002.mainly it assume that though the surrogate mother may be the child's genetic mother (the more traditional form of surrogacy), or she may be, as a gestational carrier, carry the pregnancy to delivery after having been implanted with an embryo has no claim over the child after giving birth according to deed which was accepted by her before agreeing to become surrogate mother in lieu of benefits granted to her . the all expenses of her health would be bear by contracted party and it is interesting to know that India is emerging as a leader in international surrogacy. Indian surrogates have been increasingly popular with fertile couples in industrialized nations because of the relatively low cost.
