It maybe so. But, if you judge it from another angle you'll see the terrorists are all the more strangling human rights. Maybe the idea is to combat poison with poison.

Once an outlined proposal is passed and enacted as law it can not accepted later on as a wrong law. If it deserves amendment it is to be done through a proper process. The question is ambiguous and confusing. However in case of convicting a wrong person, there is a higher forum for appealing the case for justice.
